New York Adult Survivors Act
New York recently passed the Adult Survivors Act (N.Y. C.P.L.R. §214-J), which allows adult survivors of sexual abuse to seek justice, even if the statute of limitations has expired. If you were sexually assaulted at age 18 or older and could not file a claim against the parties responsible for the incident because your case was time-barred, this new legislation gives you a one-year “lookback window” to file a civil action against the abuser and the institution that enabled the abuse. The Adult Survivors Act went into effect on November 24, 2022, giving victims of adult sexual assault and abuse up to November 24, 2023, to file a claim.
The act allows survivors to pursue action against the individual who committed the harm and any entity that enabled the abuse through what they did or failed to do. Organizations, institutional facilities, government entities, churches, schools, and other companies are examples of entities that may be held accountable if they empowered or enabled abusers or failed to protect victims.
