The parties had filed cross motions for summary judgment concerning the avoidance and recovery of a preferential transfer made by the debtors to the defendant. The court found that plaintiff’s case in chief had been met, and that no affirmative defenses shielded the defendant from avoidance and recovery of the transfer. In addition, the court ruled in favor of the plaintiff on evidentiary issues, including the ability of a plan administrator to submit a declaration in support of the plaintiff’s motion for summary judgment.
