ASK’s Kara Casteel, recently secured a victory for a client in the Bankruptcy Court for the Southern District of Texas

Mar 14, 2024

The parties had filed cross motions for summary judgment concerning the avoidance and recovery of a preferential transfer made by the debtors to the defendant. The court found that plaintiff’s case in chief had been met, and that no affirmative defenses shielded the defendant from avoidance and recovery of the transfer. In addition, the court ruled in favor of the plaintiff on evidentiary issues, including the ability of a plan administrator to submit a declaration in support of the plaintiff’s motion for summary judgment.

No matter the size of the case, ASK is dedicated to avoid and recover preferential transfers for the benefit of its clients. In this case, the transfer was relatively small compared to other preference cases. However, ASK takes seriously its commitment to prosecute avoidance actions no matter the size relative to effort involved. Clients of ASK can be assured that they receive top-tier representation and zealous advocacy in cases both large and small.
